Terms of Service

These Terms of Service ("Terms") govern your access to and use of Diehard Trader (the "Service"), operated by Ask AI Trade, Raipur, Chhattisgarh, India ("we", "us", "our") via the websites diehardtrade.com and diehardtrader.com and any associated software, including the MetaTrader 5 expert advisor ("EA") we provide.

By creating an account, installing the EA, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. What the Service is — and is not

The Service lets you create and run one or more autonomous AI traders. You describe a trader in plain English and set its mandate — markets, trading style, active schedule, and hard risk limits. On a recurring schedule the AI then observes public market data, forms a trading decision with an explicit rationale, checks that decision against the limits you set, and acts. Every trader runs first in paper mode (a simulator using live prices, with no real money at risk). Only when you explicitly switch a trader to live does it place real orders — and it does so on a MetaTrader 5 ("MT5") account you open, fund, and connect, by sending signed orders to an expert advisor ("EA") you install on your own terminal. You can pause, stop, or revert any trader to paper at any moment.

You direct the tool; we do not manage your money. The AI acts only within the mandate and limits you configure, only on accounts you control, and only after you authorise live trading. We never take custody of your funds and never hold your broker login.

We are not, and do not act as:

  • a broker, dealer, exchange, or market maker;
  • an investment adviser, financial planner, portfolio manager, or fund;
  • a fiduciary or discretionary money manager of any kind; or
  • a provider of personalised investment advice or recommendations.

The AI's decisions are generated automatically by software. They are not advice, and we do not promise, project, or guarantee any profit, income, or trading outcome (see sections 7 and 7A). We have no relationship with your broker and no control over your account beyond the orders a live trader you have authorised sends to your own EA.

The Service also includes optional AI assistants — a public "Ask AI" guide and an in-dashboard support assistant — that help you understand and use the Service. They do not provide trading advice or recommendations. See section 7A.

1A. Public live feed

To show the Service in action, we operate a public page (/live) that displays a real-time feed of trades placed by live AI traders across the Service. By switching a trader to live, you grant us a non-exclusive, royalty-free, worldwide licence to publish, under your username (and not your email, real name, trader name, broker, or account number), pseudonymous information about that trader's trades — the instrument, direction, order prices, position size, open/closed status, realised profit or loss, timestamps, and the AI's short rationale.

Paper traders are never shown. You choose your username in settings, and you may ask us to exclude your live activity from the feed by emailing [email protected] (we will honour reasonable requests); traders kept on paper never appear. You must not use a username that impersonates another person or brand, infringes a trademark, or contains anyone's personal information. This is described further in the Privacy Policy.

2. Eligibility

To use the Service, you must:

  • be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater);
  • have the legal capacity to enter into a binding contract;
  • not be barred from receiving services under the laws of India or your country of residence;
  • comply with all sanctions and export-control laws applicable to you.

You are responsible for ensuring that automated trading is lawful where you live and that your broker permits the use of third-party EAs on your account.

3. Accounts

You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account, including activity by anyone you authorise. Notify us immediately at [email protected] if you suspect unauthorised access.

We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms, applicable law, or in a way that risks harm to other users or the Service.

4. Licence to use the Service

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

  • access the Service via the dashboard at diehardtrade.com (and diehardtrader.com);
  • install and run the EA on MT5 terminals you control, solely to receive and execute the orders your authorised live AI traders send to your own account.

You may not:

  • resell, sublicense, rent, lease, or share access to the Service or your account credentials;
  • copy, decompile, reverse-engineer, or attempt to derive the source code of the EA or the backend, except to the extent applicable law expressly permits;
  • use the Service to trade on behalf of clients or other people in a way that would constitute regulated investment advice, money management, or portfolio management without holding the licences required in your jurisdiction;
  • circumvent any rate limit, authentication, signing, or other technical control.

5. Subscriptions, billing, and cancellation

The Service is offered on monthly or yearly subscription tiers. Each tier includes a monthly allowance of AI credits that meter the AI's usage (every trader decision spends credits) and a limit on how many traders you can run live. Fees, the credit allowance, and billing currency are shown on the pricing and billing pages.

  • Free allowance. Every account starts with a one-time allowance of AI credits at no charge, so you can build and run traders on paper without a card. When your allowance (free or plan) is exhausted, your AI traders pause until it renews or you upgrade; nothing is charged automatically to keep them running.
  • Payments are processed by third-party providers (currently Razorpay and PayPal). Your payment data is handled by them under their own terms and privacy policies. We never see or store full card or bank details.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled.
  • Cancellation. You may cancel at any time from the billing page in your dashboard. Cancellation takes effect at the end of the current paid period; you retain access until then.
  • No refunds. All payments are final and non-refundable. We do not provide pro-rata refunds, partial refunds, or refunds for unused time, missed trades, broker outages, or any other reason, except where a refund is required by mandatory consumer-protection law that we cannot lawfully exclude.
  • Failed payments. If a renewal payment fails, we may retry or suspend the Service. Repeated failure may result in account termination.
  • Price changes. We may change subscription prices on at least 14 days' written notice to your registered email. Changes apply from your next renewal — never mid-period. If you do not accept the new price, cancel before renewal.
  • Taxes. Prices are exclusive of any applicable taxes, duties, or levies, which you are responsible for paying.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, including market manipulation, wash trading, layering, spoofing, insider dealing, or trading on a broker account that is not your own without that account-holder's consent;
  • use the Service to facilitate money laundering, sanctions evasion, or terrorism financing;
  • use the Service in a way designed to overload the backend, the AI, the EA, or any broker;
  • attempt to gain unauthorised access to other users' data, the backend, the dashboard, or any underlying infrastructure;
  • introduce malware, scrape protected endpoints, or run security testing against the Service without our prior written consent;
  • choose or use a username that impersonates another person or brand, infringes a trademark, or contains personal data you are not entitled to publish (usernames may be shown publicly — see section 1A).

We may investigate and take any action we consider appropriate, including suspension, termination, and reporting to authorities.

7. Trading risk — read carefully

Trading leveraged products such as forex, contracts for difference (CFDs), futures, options, cryptocurrencies, and other margined instruments carries a high level of risk and may not be suitable for all investors. You can lose some or all of your invested capital, and in some cases more than your initial deposit. Past performance is not indicative of future results. No representation is made that any account will or is likely to achieve profits or losses similar to those discussed in any material, demo, backtest, or marketing.

You acknowledge and agree that:

  1. You alone are responsible for every trade placed on your broker account, including trades the AI decides on and the EA executes automatically once you have switched a trader to live. You define the mandate and limits, you choose whether and when any trader trades real money, and you can stop it at any time.
  2. The AI can be wrong and can lose money. It reasons over public market data with no inside information and no guaranteed edge; it can misjudge the market, act on flawed reasoning, or behave differently from what its mandate suggests — and because it trades automatically, it can do so quickly. Paper-first exists precisely so you can judge a trader on its own record before risking a cent; use it.
  3. We give no investment, financial, tax, or legal advice. Nothing on the website, in the dashboard, in a trader's decisions, theses, or journals, in any output of our AI assistants, in support communications, or in any other material we publish constitutes advice or a recommendation to buy, sell, or hold any instrument.
  4. You must supervise. You are responsible for evaluating each trader on paper first, setting limits appropriate to your account, monitoring its behaviour, and stopping it if it is not behaving as you intend. The guardrails you set are enforced in code, but they do not remove your duty to supervise.
  5. Execution is not guaranteed. Orders may be delayed, dropped, duplicated, reordered, executed at a price worse than expected, or not executed at all due to network latency, internet outage, server failure, MT5 terminal disconnection, broker rejection, insufficient margin, market gap, weekend closure, holiday closure, regulatory halt, or any other cause within or beyond our control.
  6. We are not your broker and have no control over spreads, slippage, swaps, commissions, fills, requotes, partial fills, broker stop-outs, broker insolvency, or any other aspect of order handling on the broker side.
  7. Automated trading can amplify losses as quickly as it can amplify gains. You must keep stop-losses and risk controls active and appropriate to your account size at all times, and you remain responsible even while a trader is running unattended.
  8. Optional position-sizing features increase risk. The Service offers optional controls — including risk-based position sizing, a per-terminal lot multiplier, and loss-based scaling (a "martingale"-style increase of size after losing trades). These can materially increase your position sizes, exposure, and potential losses, and loss-based scaling in particular can compound losses rapidly. They are off by default and used entirely at your own discretion and risk; if you enable them, set hard limits appropriate to your account.

If you do not understand these risks, do not use the Service.

7A. AI features (your AI traders and the assistants)

Your AI traders and the in-product assistants (the public "Ask AI" guide and the in-dashboard support assistant) are powered in part by a third-party AI provider (see section 12).

You acknowledge and agree that:

  1. AI decisions are generated automatically and may be wrong. A trader's decisions can be inaccurate, ill-judged, or unsuitable for your circumstances, can be based on flawed reasoning, and can behave differently from what its mandate suggests. The AI has no inside information and no guaranteed edge.
  2. Nothing the AI produces is advice. A trader's decisions, theses, journals, and the assistants' answers are not investment, financial, legal, or tax advice or a recommendation. A trader acts only within the mandate and limits you set; it does not decide your overall financial strategy for you, and you decide whether it ever trades real money.
  3. You configure, supervise, and authorise. You set each trader's mandate and hard limits, you choose whether and when to switch it to live, and you must monitor it. Every trader starts on paper; test it there before going live. The trading-risk terms in section 7 apply in full to anything you build or run using these features.
  4. No warranty. AI features are provided "as is" under section 8. We do not warrant that any trader or assistant will be accurate, error-free, profitable, or fit for any purpose.
  5. Your inputs and outputs. We store and process your trader configurations, the AI's decisions and journals, and your assistant conversations as described in the Privacy Policy. Do not submit other people's confidential information, credentials, or anything you are not entitled to share.
  6. Fair use and availability. The AI's usage is metered in credits; we may apply rate limits, pause traders when an allowance is exhausted, and suspend access for misuse. You must not use the AI features to generate unlawful content or to reverse-engineer, extract, or overload the Service, the AI provider, or the underlying models.

8. Disclaimers

To the maximum extent permitted by applicable law, the Service, the EA, the dashboard, the website, all decisions made and orders placed by your AI traders, all telemetry, all documentation, and all related materials are provided "as is" and "as available", without warranty of any kind, express, implied, statutory, or otherwise. We specifically disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, uninterrupted operation, security, and freedom from error or harmful component.

We do not warrant that:

  • the Service will be uninterrupted, error-free, or available at any particular time;
  • orders will be transmitted or executed within any specific time or at all;
  • the Service will be compatible with any particular broker, MT5 build, VPS, or operating system;
  • the Service is free of bugs, vulnerabilities, or third-party security incidents.

9. Limitation of liability

To the maximum extent permitted by applicable law:

(a) We shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, loss of revenue, loss of trading opportunity, loss of goodwill, loss of data, or loss of business, even if we have been advised of the possibility of such damages.

(b) Our total aggregate liability arising out of or relating to the Service, these Terms, or any AI decision, order, execution, omission, or interruption, whether in contract, tort (including negligence), statute, or otherwise, shall not exceed the total amount of subscription fees actually paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.

(c) The above limitations apply to all claims of every kind, including claims related to trading losses, broker losses, missed opportunities, slippage, server downtime, a wrong or poor AI decision, order delay, order loss, order duplication, data loss, breach, and any other claim of any nature.

(d) Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any such law applies to you, the above limitations apply only to the maximum extent permitted by that law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ask AI Trade and its operators, employees, contractors, and agents from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or in connection with:

  • your use of the Service;
  • any trade placed on your broker account, whether or not automated;
  • your breach of these Terms or any applicable law;
  • your infringement of any third-party right;
  • any trade decided by an AI trader you configured and authorised, or otherwise placed on your broker account.

11. Intellectual property

All intellectual property rights in the Service — including the dashboard, the EA, the backend code, the documentation, the branding, the logos, the websites, and all derivatives — remain the sole property of Ask AI Trade and its licensors. Nothing in these Terms transfers any of those rights to you. Feedback you provide may be used by us without obligation or compensation.

12. Third-party services

The Service interoperates with, and relies on, third-party services — including brokers, MetaTrader 5, Razorpay, PayPal, hosting/network providers, and the third-party AI provider that powers your AI traders and our assistants (identified in the Privacy Policy). We are not responsible for those services, their availability, their terms, their fees, or their conduct. Your relationship with any service you choose to use is governed by their own agreements with you.

13. Termination

You may terminate by cancelling your subscription and closing your account at any time.

We may suspend or terminate your access at any time, with or without notice, if:

  • you breach these Terms;
  • you fail to pay any fee when due;
  • we reasonably believe your activity is unlawful, harmful, abusive, fraudulent, or risks harm to other users or the Service;
  • we are required to do so by law, court order, or competent authority;
  • we cease offering the Service.

On termination, your licence ends immediately. Sections that by their nature should survive termination — including risk disclosures, disclaimers, limitation of liability, indemnification, intellectual property, governing law, and dispute resolution — will survive.

14. Changes to the Service or these Terms

We may modify or discontinue any part of the Service at any time. We may also update these Terms; the "Last updated" date above will change accordingly. For material changes, we will notify you by email and/or an in-dashboard notice at least 14 days before they take effect. Continued use of the Service after a change indicates acceptance of the updated Terms.

15. Force majeure

We are not liable for any failure or delay in performance caused by events outside our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government action, sanctions, pandemic, fire, flood, earthquake, power failure, internet outage, third-party service outage, broker outage, exchange halt, denial-of-service attack, or telecommunications failure.

16. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. The courts at Raipur, Chhattisgarh, India shall have exclusive jurisdiction to settle any such dispute, and you irrevocably submit to that jurisdiction.

17. Miscellaneous

  • Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them to a successor in connection with a corporate reorganisation, merger, or sale of substantially all of our assets.
  • Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms shown at checkout, constitute the entire agreement between you and us regarding the Service and supersede any prior agreement.
  • Notices to you may be sent by email to your registered address or posted in the dashboard. Notices to us must be sent to [email protected].
